RollRecall — Terms of Service

The short version
By using RollRecall you agree to these Terms. The most important things to know:
- RollRecall is a beta - it's improving fast, and things may occasionally change or break.
- You're responsible for getting everyone's consent before you record them.
- You own your content. You give us permission to process it so we can run the service for you.
- Our AI recaps are helpful but not always perfect - review them before relying on them.
- RollRecall is provided "as is," and our liability is limited, as spelled out below.

1. Agreement to these Terms
These Terms of Service ("Terms") are a binding agreement between you and RollRecall, operated by John Maier ("RollRecall," "we," "us"). By creating an account or using RollRecall, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use RollRecall.
2. Who can use RollRecall
You must be at least 13 years old to use RollRecall. If you're under the age of majority where you live, you may only use RollRecall with the involvement of a parent or guardian. By using RollRecall, you confirm you meet these requirements and that the information you give us is accurate.
3. What RollRecall is
RollRecall records your tabletop roleplaying sessions and uses AI to turn them into recaps, a living wiki, character memory, highlights, and related features. RollRecall is currently in beta. That means features may change, be added, or be removed, and the service may occasionally be unavailable or produce imperfect results. We'll do our best to keep it reliable, but we can't promise it will always be error-free.
4. Your account
Access to RollRecall is currently invite-based - you join by accepting an invitation to a campaign. You're responsible for keeping your login details secure and for everything that happens under your account. Let us know at support@rollrecall.app if you think someone else has accessed your account.
5. Recording and consent (important)
RollRecall records the voices of everyone present at your session. You are solely responsible for ensuring that every person being recorded knows about the recording and has agreed to it before you start, in accordance with the laws that apply to you. You must not record anyone without their consent, and you must not record a minor without their parent or guardian's consent. You agree that you, not RollRecall, are responsible for obtaining these consents, and you'll indemnify us for claims that arise from recordings you make (see Section 14).
6. Acceptable use
When using RollRecall, you agree not to:
- record anyone without their knowledge and consent;
- upload or create content that's illegal, infringing, harassing, or violates someone else's rights;
- attempt to break, overload, reverse-engineer, or gain unauthorized access to the service;
- use RollRecall to build a competing product from our data; or
- use RollRecall in any way that breaks the law or these Terms.
We may suspend or terminate accounts that violate these rules.
7. Your content and the permission you give us
You own the content you create with RollRecall - your recordings, transcripts, notes, and the generated recaps and other material tied to your account and campaigns.
To operate the service, you give RollRecall a limited, non-exclusive license to store, process, transcribe, analyze, and display your content solely to provide and improve RollRecall for you and the members of your campaigns. This license exists only so the app can function (for example, sending your audio to be transcribed, or showing campaign content to your group). It ends when you delete the content or your account, except for content others in your campaign still retain, and except for limited backups as described in the Privacy Policy. We don't claim ownership of your content and we don't use it to advertise.
8. AI-generated content
RollRecall uses AI to generate recaps, wiki entries, and other content from your sessions. This content can be inaccurate, incomplete, or misremember details - think of RollRecall as a helpful scribe, not an authoritative record. You're responsible for reviewing AI-generated content before relying on it. We're not liable for decisions you make based on it.
9. Third-party services
RollRecall relies on third-party providers (including AssemblyAI for transcription and Anthropic for AI generation) to function. Your use of RollRecall also depends on those services, and your content is processed by them as described in our Privacy Policy. We're not responsible for the acts or omissions of third-party providers beyond our reasonable control.
10. Fees
RollRecall is currently free to use during beta. We may introduce paid plans in the future. If we do, we'll give you notice and you'll be able to choose whether to continue on a paid plan. We won't start charging you for something that's currently free without telling you first.
11. Our intellectual property
RollRecall's name, logo, design, software, and content (other than your content) belong to us and are protected by law. These Terms don't give you any right to use our branding or copy our software except as needed to use the service normally.
12. Termination
You can stop using RollRecall and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the service. If we discontinue RollRecall, we'll try to give you reasonable notice and a chance to export or delete your data.
13. Disclaimers
RollRecall is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't warrant that the service will be uninterrupted, secure, error-free, or that AI-generated content will be accurate. You use RollRecall at your own risk.
14. Limitation of liability and indemnification
Limitation of liability. To the fullest extent permitted by law, RollRecall and John Maier will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of RollRecall. To the fullest extent permitted by law, our total liability for any claim relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US 50 dollars.
Indemnification. You agree to defend, indemnify, and hold harmless RollRecall and John Maier from any claims, damages, or expenses (including reasonable legal fees) arising from your use of RollRecall, your content, or your violation of these Terms - including any claim that you recorded someone without their consent.
15. Changes to the service and these Terms
We may update the service and these Terms as RollRecall evolves. If we make a meaningful change to these Terms, we'll update the "Last updated" date and, where appropriate, notify you in the app or by email. Continuing to use RollRecall after a change means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules. Any disputes will be handled in the state or federal courts located in Michigan, and you agree to that jurisdiction.
